AQNS HOSTING Terms Of Service:

AQNS HOSTING provides web page, VPS and Dedicated servers hosting. AQNS HOSTING reserves the right to suspend or cancel a customer's access to any or all services provided by AQNS HOSTING when AQNS HOSTING decides that the account has been inappropriately used or otherwise.

 

1. Server Usage

Personal accounts are to be used by the primary owner only. Personal account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads. AQNS HOSTING reserves the right to refuse service and /or access to its servers to anyone. Each individual is allowed ONE account only. AQNS HOSTING does not allow any of the following content to be stored on its servers:

 

» Illegal Material : This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. You may not store copyrighted Mp3s on your webspace in any way shape or form. 

» Adult Material : Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of AQNS HOSTING. 

» Warez : Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Sites which provides ‘link to’ are allowed.

» Anime : Copyrighted anime is not allowed on our servers. This includes variations of anime including manga, hentai etc. Also inlcudes any sites which provide links to information about such material. If you created the material yourself, you may host the content on your site. 

» Proxies : We do not allow proxies of any kind on our servers. 
 

 

2. High Resource Usage Policy

Resources are defined as bandwidth and/or processor utilization. AQNS HOSTING may implement the following policy to its sole discretion: When a website is found to be monopolizing the resources available on AQNS HOSTING shared hosting servers, AQNS HOSTING reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Each account has only a maximum resource usage of 21% of the total resources available on the server. Customers may be offered an option whereby AQNS HOSTING continues hosting the website for an additional fee. (This applies to Shared Hosting ONLY).

 

3. Cancellation and Refunds

AQNS HOSTING reserves the right to cancel the service at any time. In this event customers will be entitled to a pro-rated refund based upon the remaining period of membership. If a customer contravenes AQNS HOSTING's terms of service, a refund will not be issued in the event of a cancellation. Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation. Fees charged on a prepay basis are non-refundable.

 

4. Indemnification

Customer agrees that it shall defend, indemnify, save and hold AQNS HOSTING harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against AQNS HOSTING, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless AQNS HOSTING against liabilities arising out of;

(1) Any injury to person or property caused by any products sold or otherwise distributed in connection with AQNS HOSTING's server;

(2) Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;

(3) Copyright infringement and

(4) Any defective products sold to customer from AQNS HOSTING's server.

 

5. System Backups

Backups of all customer data are solely the responsibility of the client. AQNS HOSTING does full backups every 2-3 days, these are to be used for system restore only, and are not tested for individual account backup. Any other questions on this policy should be directed to the staff.

 

6. Disclaimer

AQNS HOSTING will not be responsible for any damages your business may suffer. AQNS HOSTING makes no warranties of any kind, expressed or implied for services we provide. AQNS HOSTING disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by AQNS HOSTING and its employees.

AQNS HOSTING can change the contents of the TOS as per required.

 
Dedicated / VPS / Shared TOS PDF Print E-mail

You will be held responsible for all actions performed by your account whether it be done by you or by others! If server security is compromised, the account holder is responsible for all violations of the TOS and AUP, including SPAM, and all disconnect and reconnect fees associated with violations.

AQNS Hosting Responsibilities

AQNS Hosting agrees to provide services, which are paid for, to the Customer, subject to complete compliance to the AUP and TOS. AQNS Hosting reserves the right to refuse any potential customer, at the sole discretion of AQNS Hosting.

Changes

The TOS and AUP are both subject to change at any time at the sole discretion of AQNS Hosting and in most cases prior notices won't be communicated, a change in policy shall not be grounds for early contract termination or non-payment. Customer recognizes that the nature of the service supplied and the initial rates and charges have been communicated to Customer. The Customer is aware that from time to time rates may change based on availability of hardware and overall market fluctuations, if a change is going to in any way alter the recurring monthly bill of a customer, it will be communicated prior to actual billing.

Non-Payment/Service Interruption

Service interrupted for non-payment is subject to a $50 reactivation fee. Data stored on a Customer Servers will not be available to the customer until reconnection is established. Customers deactivated for non-payment or charge-back are subject to their data being destroyed after 10 days from termination/charge-back date.

Refunds/Charge Backs

All services except Shared and Reseller hosting provided by AQNS Hosting are not eligible for a refund. All overcharges or charge disputes must be reported within 30 days of the time that the dispute occurred. If a charge, that is deemed valid by the sole discretion of AQNS Hosting and validated by our TOS or AUP, is disputed to your Credit Card Issuer by issuing a charge-back, then you agree to pay an 'Administrative Fee' of $50 fee, in addition to whatever amount of money was charged back.

No refunds are given on Domains, Dedicated Servers or VPSs under any circumstances what so ever

Refunds on Shared and Reseller Hosting are given on the Sole Discretion of AQNS Hosting 

Cancellations

AQNS Hosting requires a five (5) day notice of cancellation prior to the billing date for the upcoming term. A five (5) day notice before the upcoming billing date is also required for any downgrades. All customer data will be destroyed 10 days after the cancellation date.

Fraud

In the event fraud is discovered, fraudulent customer is subject to immediate suspension/termination at the sole discretion of AQNS Hosting. All information available to AQNS Hosting about the fraudulent account/server will be submitted to both local authorities, as well any financial institutions involved. All fraud orders are investigated, and all fraudulent customers will be prosecuted to the fullest extent of the law, whether it is within the United States, or abroad.

Financial Liability

The Customer acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of AQNS Hosting, and that damages resulting from any interruption of service are difficult to ascertain. Therefore, the Customer agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of AQNS Hosting. The Customer further acknowledges that AQNS Hosting Network's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred.

Support

AQNS Hosting provides hardware support related to customers server functioning. AQNS Hosting does not offer software support outside of the installation of items chosen from the order form. AQNS Hosting only guarantees the default installation of any software, and in no way assumes liability for the configuration of any software. AQNS Hosting is not responsible for any downtime associated with mis-configuration of Operating System Kernels. AQNS Hosting may provide enhanced software support (including kernel configuration), for an additional fee. Please ask sales or support for enhanced support pricing. One free Operating System reinstallation is provided to all customers, each additional Operating System reinstallation will be a flat $50 fee. AQNS Hosting does not provide any type of Support to the Customers of our Customers (Third Party Customers). We will only provide support directly to Customers of AQNS Hosting.

Spam/Bulk Email Policy

SPAM complaint procedure:

  • Identify the server the spam was initially sent from (via IP)
  • Create a comprehensive list of the spam complaints associated with the server in question.
  • An instance of a spam complaint is defined as one marketing E-mail.
  • An Abuse Notification may, and typically will be, comprised of numerous spam complaints.

First Spam Abuse Notification (AQNS Hosting -> Client):

  • Provide the Abuse Notification to the client, and assess a $25 fine. Failure to pay the fine within 24 hours may result in service interruption, due to suspension.
  • After three Abuse Notifications are issued service may be subject to termination, as well as ineligibility to order any future servers.
  • If an IP range or IP address has been black-listed as a result of a spam complaint, AQNS Hosting will issue a fine of $200 and may terminate the service.
  • Upon receiving complaints, AQNS Hosting will notify the client by issuing an abuse notification.
    • On the first notification, AQNS Hosting will warn the client, as well as issue a $25 fine.
    • On the second notification, AQNS Hosting will issue a fine of $25.00 per complaint received, with a maximum of 5.
    • On the third complaint, AQNS Hosting will terminate service as well as issue a fine of $25.00 per additional complaint received, with a maximum of 10.
  • Compromised Servers Issued Spam Notifications: If AQNS Hosting suspects that a client's server has been infiltrated in an effort to send Spam/Bulk e-mail, AQNS Hosting will offer the following options:
    • Offer a free Operating System reinstallation, setting the configuration back to the original state it was provisioned in.
    • If Operating System reinstallation is not accepted as an option, AQNS Hosting may offer to manually retrieve/repair the files on the server, at a fee to be assessed and paid prior to any work being done.
    • On the second instance of server compromise AQNS Hosting reserves the right to terminate the client's services.

If any Spam complaints are disputed, and fines wish to be disregarded, full logs, as well as any requested information must be provided within 24 hours of the initial Abuse Notification. Failure to dispute, or provide required information within the 24 hour time period is acceptance of the notification, and all fees associated with it.

DMCA Complaints

AQNS Hosting handles any and all DMCA complaints very seriously, and will investigate them. AQNS Hosting reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. The first violation of this policy will result in an 'Administrative Fee' of $50, and if severe enough, potential termination of the server or account. A second violation will result in an 'Administrative Fee' of $100 and will also result in the immediate termination of the server or account. Users who violate this policy agree that in addition to these "Administrative" penalties, they will pay "Research Fees" not to exceed $75 per hour that AQNS Hosting personnel must spend to investigate the matter, to be charged only if claims are found to be valid. We take DMCA Complaints extremely seriously, save yourself and us the trouble.

Usage and Overages

Customers Agree to pay any and all overage charges accrued on their account from the previous month. Overage charges are billed per gigabyte at a rate of $.25 (twenty five cents). AQNS Hosting reserves the right to suspend any account which does not pay all overage charges. AQNS Hosting is not responsible for spikes in bandwidth that are caused on a customer's server for any reason. Customer is liable for all bandwidth to and from their server.

Payment Verification

Customers agree to potentially having to submit to fraud checking measures, designed for both the security of the customer as well as the security of AQNS Hosting. The fraud checks may require that the faxing/emailing of two forms of Government issued identification to AQNS Hosting, and also a front and back copy of the Credit Card used as payment, as well as a copy of a utility bill will the billing address.

Publicity

Customer agrees that AQNS Hosting may publicly disclose that they are providing services(s) to the customer, and may include customer's name in promotional materials. AQNS Hosting reserves the right to use customer quotes for promotional use. If this is undesired, the customer may request to opt out of promotional use by contacting sales.
